Kukkumiskaitse reserves the right to modify the terms of use of the E-store as well as the prices of its products and services by providing notice on the Website. Transactions are subject to the terms and prices in effect at the time of the transaction.

1. Ordering Products and Delivery

The Website www.kukkumiskaitse.ee allows you to view our product catalog and selection. All prices displayed in the E-store are in euros (€) and include VAT. Product prices and discounts in the E-store may differ from those offered by Kukkumiskaitse’s resellers. Images of products shown on the Website are for illustrative purposes only and may slightly differ from the actual appearance of the product.

To order products, you may use the E-store or submit an order via email to abi@kukkumiskaitse.ee, including the product description or specific product code, quantity, size, and your contact information. Kukkumiskaitse is not responsible for fulfillment issues caused by inaccurate data provided by the customer or for any consequences arising from such inaccuracies. Kukkumiskaitse reserves the right to decline an order if there is doubt about the accuracy of the provided data or if the behavior is deemed inappropriate.

The availability of products shown in the E-store is not guaranteed. If an ordered product cannot be delivered due to unavailability or other reasons, the customer will be informed as soon as possible, and the total purchase amount will be refunded immediately after the unavailability is confirmed.

The price of delivery is added to the product price. Products are shipped to the following country: Estonia. The delivery fee depends on the customer’s location and the chosen delivery method, and it is displayed to the customer during the checkout process. If the total order value exceeds €200, delivery within Estonia is free of charge (excluding special projects). Domestic shipments within Estonia are typically delivered within 2–4 working days after the conclusion of the sales agreement. If Kukkumiskaitse informs the customer on the Website or in the order confirmation about delivery delays, the announced timeframe will apply.

To order, add the desired products to your shopping cart. To finalize the order, fill in the required fields and select your preferred delivery method. The total order amount will then be displayed, and payment can be made via bank link (through Montonio Finance UAB) or by bank transfer (EUR). Payments via invoice should be made to Coop Pank IBAN: EE804204278602055207, SWIFT/BIC: EKRDEE22. Please include the invoice number in the payment reference. Customers picking up the goods at the office may pay in cash.

The agreement becomes effective once the payment has been credited to Kukkumiskaitse OÜ’s account. After payment is received, the goods will be delivered via DPD parcel machine or OSC courier to the customer’s specified destination. Customers may also pick up their orders at the Kukkumiskaitse office (Vitamiini 6a, Tartu) after prior notice by calling +372 56 111 024.

The customer is responsible for verifying the accuracy of the contact information provided before finalizing the order to avoid delays or misunderstandings in delivery. Kukkumiskaitse is not liable for delays or issues caused by incorrect or inaccurate information provided by the customer during order placement.

If the product arrives in a damaged condition or with an open package, the customer must notify Kukkumiskaitse immediately by emailing abi@kukkumiskaitse.ee.

2. Right of Withdrawal

Customers have the right to cancel their order without providing a reason within 14 days and either exchange or return the purchased product(s). The 14-day withdrawal period starts upon receipt of the product at the terminal or upon delivery by courier/personal pick-up. The right of withdrawal does not apply to legal entities.

To cancel the order, a withdrawal notice must be submitted within 14 days of receiving the product/terminal notification by email to abi@kukkumiskaitse.ee. The product must be returned to Kukkumiskaitse’s office/warehouse (Vitamiini 6a, Tartu) or handed over to a logistics company within 14 days of submitting the withdrawal notice.

In order to use the 14-day right of return, the product must not be used in any way other than what is necessary to ascertain its nature, properties, and functionality, in a manner similar to testing the product in a physical store. Products are not eligible for exchange or return if their tags have been removed, if they have been used under improper conditions or contrary to the requirements specified in the user manual, if they have been stored in unsuitable conditions, if they have been improperly maintained, resulting in mechanical damage (burns, cuts, tears, chemical damage, etc.), or if there are visible signs of use.

Kukkumiskaitse will refund the purchase amount to the customer within 30 days of receiving the return request. The refund will be made to the same bank account from which the Buyer paid for the returned order. We reserve the right to delay the refund if the goods have not been received or if we have not received proof that the goods have been returned. The Buyer is responsible for covering the costs associated with returning the goods, except in cases where the reason for the return is that the product does not match the order. If the order included a delivery fee, Kukkumiskaitse will also refund this fee.

If the Buyer has explicitly chosen a delivery method other than the standard least expensive delivery option offered by the E-store, Kukkumiskaitse is not obligated to refund the Buyer for the portion of the cost that exceeds the cost of the standard delivery method.

3. Complaints Procedure

Products are subject to a 2-year complaint period under the law, and any defects must be reported within 2 months of their discovery. If a defect in the product is detected, please immediately stop using the product.

In case of complaints, please send an email to abi@kukkumiskaitse.ee including the Buyer’s contact details, a detailed description of the issue, and the invoice number. The customer will be contacted at the earliest opportunity, but no later than 15 days after receiving the complaint.

If a product purchased online has defects for which Kukkumiskaitse is responsible, Kukkumiskaitse will repair or replace the defective product. If the product cannot be repaired or replaced, Kukkumiskaitse will refund all fees associated with the sales contract.

Kukkumiskaitse is not liable for any damages resulting from the improper use of ordered products, nor for delivery delays caused by circumstances beyond Kukkumiskaitse’s control and/or due to force majeure events not attributable to the company.

Kukkumiskaitse will not reimburse the Buyer for any expenses incurred in the event of non-compliance with product specifications or defects, nor will it be liable for such expenses if the product’s value has decreased/damaged due to the Buyer’s fault, if the defects arose from improper use of the product, including failure to follow the user manual, if the product’s value has decreased due to natural wear and tear from normal use, or if there is no proof of purchase.

6. Intellectual Property

The trademarks, logos, software, copyrights, and domain name on the website are the intellectual property of Kukkumiskaitse or other third parties. Kukkumiskaitse does not grant any rights to use intellectual property, except to the extent necessary for the use of the website. The user may not copy or make the content of the website available to the public without prior consent from Kukkumiskaitse.

7. Terms of Use and Amendments

By making a purchase from the online store, the customer agrees to the terms of use of the online store and commits to complying with them. The sales contract between Kukkumiskaitse and the customer becomes effective upon the receipt of the payment for the purchase amount to Kukkumiskaitse’s bank account.

Kukkumiskaitse may change the terms of use and product prices. Notice of changes will be published on the website. The terms and prices that apply to a transaction are those in effect at the time the transaction is made.

Kukkumiskaitse has the right to cancel the order if, due to a technical error, the product price displayed in the online store was incorrect.

8. Rights and Responsibility

Kukkumiskaitse and the customer are responsible for any damage caused to the other party due to a breach of these terms of use, in accordance with the applicable laws of the Republic of Estonia.

You agree that accessing and using the website is at your own risk. It is prohibited to use the services offered on the website in an uncivil, offensive, or illegal manner. The customer agrees to use the online store’s services solely for lawful purposes and in accordance with good practices. Kukkumiskaitse has the right to restrict access to the website or make technical and other programmatic changes.

Kukkumiskaitse is not liable for any damages that may arise from the use of the website, the inability to use it, interruptions, changes to data, or data loss or deletion, if such events occur due to reasons beyond the control of Kukkumiskaitse. Kukkumiskaitse is only liable to the extent of the product’s purchase price.

The website may contain links and references to other websites owned by third parties, over which Kukkumiskaitse has no control. Kukkumiskaitse is not responsible for the actions of third parties. Service providers are solely responsible for their activities and materials.

The terms are governed by the laws of the Republic of Estonia. Disputes will be resolved through negotiation. If an individual is not satisfied with Kukkumiskaitse’s services, they have the right to address the issue with the Consumer Disputes Committee operating under the Consumer Protection Board. The review of the dispute in the committee is free of charge.
