Principles of training organization

1. General Provisions

1.1. Kukkumiskaitse OÜ (hereinafter referred to as Kukkumiskaitse) organizes job-related further training for adults throughout Estonia, both as public and in-house courses.
1.2. Kukkumiskaitse organizes further training in accordance with applicable legal acts in the field of adult education, as well as other relevant legal acts and documents.
1.3. Classes are held year-round. Trainings usually take place as in-house courses according to the Client’s wishes and in the Client’s premises. Requirements for the learning environment are described in the curriculum. Dates for open courses are published on Kukkumiskaitse’s website.
1.4. The duration of the training is calculated in academic hours, with one academic hour corresponding to 45 minutes.
1.5. The foundation document for the studies is the curriculum, which specifies:
1.5.1. The title of the curriculum;
1.5.2. The curriculum area;
1.5.3. Learning outcomes;
1.5.4. Conditions for starting the studies, if they are prerequisites for achieving the learning outcomes;
1.5.5. Total study volume, including the share of classroom, practical, and independent work;
1.5.6. Study content;
1.5.7. Description of the learning environment;
1.5.8. List of study materials, if the curriculum includes required study materials;
1.5.9. Graduation requirements and documents issued;
1.5.10. The qualification, learning, or work experience required for conducting the training.
1.6. Teaching is conducted in Estonian or Russian.
1.7. Kukkumiskaitse is not responsible for the health condition or possible injuries of training participants.
1.8. Kukkumiskaitse has the right to record training sessions in video and photo materials for marketing purposes, and to use them on the company’s public channels unless otherwise agreed with the Client.

2. Personal Data Processing and Data Protection Conditions

Kukkumiskaitse collects and processes the following data about learners: name, company, contact phone, email, and, at the Client’s request, personal identification code. The personal identification code is necessary for marking on certificates or proofs. Personal data is processed in accordance with the Personal Data Protection Act. The responsible data processor is Kukkumiskaitse OÜ. Reasonable organizational and technical solutions are applied to protect the collected personal data from unlawful use. More detailed data protection conditions can be found on Kukkumiskaitse’s website under the section “Data Protection Conditions.” By registering for training, the learner confirms their consent to Kukkumiskaitse’s data protection conditions.

3. Curriculum Groups

Kukkumiskaitse organizes training in the following curriculum groups: Service – Hygiene and Occupational Health – Occupational Safety and Protection – Occupational Safety.

4. Registration for Training and Group Formation

4.1. Prior registration is required for training. Registration can be done via Kukkumiskaitse’s email: abi@kukkumiskaitse.ee. The responsible person for the registration or group will receive a confirmation via email.
4.2. Registration for the training also serves as confirmation of the payment of the invoice. In most cases, Kukkumiskaitse sends the training invoice after the training session.
4.3. Learners can start their studies if they meet the conditions set out in the curriculum and have been accepted into the training group by Kukkumiskaitse.
4.4. The group size is determined in the offer or on Kukkumiskaitse’s website.
4.5. Kukkumiskaitse has the right to cancel or postpone the training if the group size is insufficient until the group is full. Registered participants will be notified by phone or email at least two days in advance.
4.6. Attendance is confirmed by the participant’s signature on the registration sheet at the beginning of each training day.
4.7. The learner has the right to receive additional information from Kukkumiskaitse employees, whose contact information can be found on the “Contact” section of Kukkumiskaitse’s website.

5. Completion of Training and Exclusion

5.1. Learners are admitted to training based on personal or company training orders.
5.2. Learners may be excluded from the training group upon their own request or if the learner does not attend the agreed training day.
5.3. Kukkumiskaitse has the right to exclude a participant from the group if the learner behaves improperly and/or disrupts or threatens other learners or the instructor.
5.4. Conditions for completing the training are specified in the curriculum. After completion of the course, the participant will receive a certificate or proof of completion.

6. Tuition Fee and Exemption

6.1. The tuition fee is set by Kukkumiskaitse when the training is published on the website. For in-house training, the price is determined by an offer, which is not public to other parties. The training company is subject to VAT, and the prices will include 22% VAT.
6.2. The tuition fee will not be increased during the course, but discounts may be applied for special offers. Special offers will be set according to the specific situation.
6.3. Payment for the training is made according to the invoice within the payment deadline. The invoice will be sent by email or as an e-invoice.
6.4. If the payment deadline exceeds 30 days and/or despite reminders from Kukkumiskaitse, the unpaid invoice will be forwarded to a collection agency.
6.5. The training fee includes classroom and practical training, and an electronic certificate or digital and plastic card certificate unless otherwise specified in the offer or curriculum. Coffee breaks and lunch are not included in the price unless agreed otherwise.

7. Withdrawal from Training

7.1. If a participant or a company ordering the training cannot attend, they must notify the training company in writing no later than 5 working days before the training takes place. If notified on time, no invoice will be issued. If less than 5 working days before the training, 50% of the invoice is due.
7.2. If the client does not notify non-participation and does not attend, the full invoice amount is due.
7.3. In case of discontinuation of the training, the tuition fee will not be refunded.

8. Learner’s Rights and Obligations

8.1. The learner has the right to:
8.1.1. receive information about the organization and curriculum of the training;
8.1.2. attend the training provided by Kukkumiskaitse as specified in the offer and at the time and location stated in the curriculum;
8.1.3. request a refund for training cancelled by Kukkumiskaitse;
8.1.4. leave the course voluntarily before the end, but the tuition fee will not be refunded;
8.1.5. receive a certificate or proof of participation at the end of the course as per the conditions in the curriculum.
8.2. The learner is obligated to:
8.2.1. handle study materials and the learning environment responsibly;
8.2.2. pay the tuition fee in full and on time;
8.2.3. behave according to general ethical norms;
8.2.4. act according to emergency procedures as outlined by the instructor or the venue;
8.2.5. not film, photograph, or record the training materials or session unless agreed otherwise with the instructor.

9. Training Materials

The training materials provided during the training are protected by copyright. The ownership of these materials belongs to the instructor and Kukkumiskaitse. They may not be used, distributed, modified, reproduced, displayed, sold, rented, or publicly shown without written permission from Kukkumiskaitse.

10. Issuance of Certificates, Proofs, and Duplicates

10.1. Certificates and proofs are generally issued in digital form, but some may also be issued as plastic card certificates. The certificates and proofs are numbered, and Kukkumiskaitse keeps track of them.
10.2. Kukkumiskaitse’s certificates and proofs contain the following information:
10.2.1. The name of the person who participated in or completed the training, and optionally the personal identification code;
10.2.2. The name of the training institution;
10.2.3. The title of the curriculum;
10.2.4. The date of the training;
10.2.5. The issuing date and place of the certificate or proof;
10.2.6. The certificate or proof number;
10.2.7. The topics covered during the training;
10.2.8. The certificate’s validity period, after which the participant must renew their knowledge.
10.3. If a participant loses their certificate or proof, Kukkumiskaitse can issue a duplicate:
10.3.1. The fee for a duplicate certificate or proof is 10€, plus 22% VAT.
10.3.2. The fee for a plastic card duplicate is 12€, plus 22% VAT.

11. Quality Assurance of Curricula, Instructors, and Learning Environment

The quality assurance principles for curricula, instructors, and the learning environment are described on Kukkumiskaitse’s website under the section “Quality Assurance Principles.

12 .Client Communication

12.1. The language of communication with clients is Estonian, and as needed, Russian and English.
12.2. Kukkumiskaitse’s contact information is listed on the “Contact” section of the Kukkumiskaitse website.

13. Tax Refund for Training Costs

Tax refunds for training costs for adult education participants and hobby school learners are regulated by the Income Tax Act.

14. Force Majeure

If the organization of training is partially or fully hindered due to force majeure, Kukkumiskaitse is not obligated to carry out or complete the training, issue materials, certificates, or proofs for a missed or partially completed training, or refund participants for the missed training fee.

16. Dispute Resolution

Any disagreements or disputes between the participant and Kukkumiskaitse or the instructor will primarily be resolved through negotiation. If the disagreement cannot be resolved through negotiation, the dispute will be settled in Tartu County Court.
